Terms of Use

These Terms of Use (the “Terms”) govern your access to and use of FireSafetyToolkit.com (the “Site”) and all content, tools, calculators, and other resources provided through it (collectively, the “Services”).

By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Site.

Note: These Terms contain important disclaimers of warranties and limitations of liability. Please read them carefully.

  1. Eligibility and Intended Users

The Services are intended for use by:

  • individuals who are at least 18 years old; and
  • professionals or organizations with relevant technical competence (such as engineers, fire protection consultants, process safety professionals, facility managers, and similar roles).

The Services are not intended for use by individual consumers for personal, household, or family purposes. By using the Site, you represent and warrant that you meet these requirements.

  1. No Professional Advice

All information, tools, calculators, checklists, examples, and other content available on or through the Site are provided for general informational and educational purposes only.

They do not constitute:

  • professional engineering, fire protection, or process safety advice;
  • design, specification, or approval of systems, equipment, or facilities;
  • legal, regulatory, compliance, or code‑interpretation advice; or
  • any other professional or expert advice.

You remain solely responsible for obtaining independent advice from qualified professionals (such as licensed engineers, safety experts, and legal counsel) before making any decisions or taking any actions that may affect safety, compliance, design, operations, or business outcomes.

  1. Tools, Calculators, Codes, and Standards

The Site may include technical content, including but not limited to:

  • calculators and tools,
  • templates and checklists,
  • worked examples and guidance related to codes and standards.

You acknowledge and agree that:

  1. Approximations and Assumptions
    Many tools and examples rely on simplified models, assumptions, default inputs, or partial datasets. They may not reflect all relevant factors, site‑specific conditions, or current regulatory requirements.
  2. No Guarantee of Accuracy or Completeness
    While reasonable efforts may be made to improve quality, no guarantee is given that any information, calculation, classification, output, or recommendation is accurate, complete, current, or suitable for your specific application.
  3. Not a Substitute for Official Codes and Standards
    The Services are not a substitute for the official, current versions of any code, standard, or regulation (including, but not limited to, NFPA standards, FM Global data sheets, or local laws and regulations).
    You are solely responsible for consulting the official, up‑to‑date texts that apply to your project, facility, or jurisdiction.
  4. No Affiliation with Standards Bodies
    The Site and its owners are not affiliated with, endorsed by, or acting on behalf of any standards organizations, insurers, or authorities having jurisdiction, including but not limited to NFPA, FM Global, or any governmental regulator.
  5. No Duty to Update
    Codes, standards, laws, and technical guidance may change over time. The Site owners do not undertake any obligation to update the Site or Services to reflect such changes. You are responsible for ensuring that you rely only on current and applicable requirements.
  6. User Responsibility
    You are solely responsible for:

    • verifying all inputs and outputs;
    • validating results against applicable codes, standards, and regulations;
    • reviewing all results with qualified professionals and authorities having jurisdiction before relying on them.

The Site and Services do not provide design approvals and do not satisfy any legal or regulatory requirement for engineering, safety, or compliance documentation.

  1. User Responsibilities and Acceptable Use

You agree to use the Site and Services only for lawful purposes and in accordance with these Terms. Without limitation, you must not:

  • rely on unverified results from the Site as the sole basis for safety‑critical decisions;
  • present any outputs as “certified,” “approved,” or “endorsed” by any standards body, regulator, insurer, or by the Site owners;
  • use the Site in any manner that violates applicable laws, regulations, codes, or standards;
  • copy or extract substantial portions of the Site or Services for the purpose of creating a competing service;
  • use automated tools (such as bots or scrapers) to access, query, or copy the Site in a manner that imposes an unreasonable load or circumvents normal user interfaces.

You are responsible for any consequences arising from your use of the Site and the decisions you make based on its content.

  1. Intellectual Property and Prohibition on Copying

Unless otherwise stated, all content on the Site, including but not limited to text, graphics, logos, icons, images, page layouts, and the logic or structure of tools and calculators, is owned by or licensed to the Site owners and protected by copyright, trademark, and other intellectual property laws.

Subject to these Terms, you may:

  • access and view the Site for your own internal professional or organizational use; and
  • print or download limited portions of the content for internal reference, provided that all copyright and proprietary notices are retained and the materials are not further copied, distributed, or published.

You may not, without the prior written consent of the Site owners:

  • copy, reproduce, download, store, transmit, distribute, publish, or otherwise make available to any third party any substantial portion of the Site or Services;
  • publicly display, perform, or post content from the Site on other websites, platforms, or media;
  • create derivative works or adaptations based on any content, tools, or calculators on the Site;
  • reproduce or adapt the tools or calculators as standalone products or services;
  • remove or alter any copyright, trademark, or other proprietary notices.

Any unauthorized use of the Site or its content may violate intellectual property laws and these Terms and may result in civil and/or criminal liability.

  1. Third‑Party Links and References

The Site may contain links or references to third‑party websites, documents, codes, standards, or other resources (“Third‑Party Content”). These are provided solely for convenience.

The Site owners:

  • do not control, endorse, or guarantee any Third‑Party Content; and
  • are not responsible for any loss or damage arising from your access to or use of Third‑Party Content.

You are responsible for reviewing the terms, conditions, and policies of any third‑party sites or documents you access.

  1. Disclaimers of Warranties

THE SITE AND ALL SERVICES, CONTENT, TOOLS, AND CALCULATORS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

WITHOUT LIMITING THE FOREGOING, THE SITE OWNERS EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT;
  • ANY WARRANTY THAT THE SITE OR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR‑FREE;
  • ANY WARRANTY THAT RESULTS OR OUTPUTS FROM ANY TOOLS OR CALCULATORS WILL BE CORRECT, RELIABLE, OR SUITABLE FOR ANY PARTICULAR USE.

YOUR USE OF THE SITE AND SERVICES IS AT YOUR SOLE RISK.

  1. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE SITE OWNERS, THEIR AFFILIATES, OR THEIR RESPECTIVE OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES;
  • LOSS OF PROFITS, REVENUE, BUSINESS, DATA, OR GOODWILL;
  • PERSONAL INJURY, PROPERTY DAMAGE, OR ENVIRONMENTAL DAMAGE,

ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT ANY LIABILITY CANNOT BE EXCLUDED, THE TOTAL AGGREGATE LIABILITY OF THE SITE OWNERS AND THEIR AFFILIATES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR SERVICES SHALL NOT EXCEED THE GREATER OF:

  1. USD $100 (ONE HUNDRED DOLLARS); OR
  2. THE TOTAL AMOUNT (IF ANY) YOU PAID TO THE SITE OWNERS FOR ACCESS TO OR USE OF THE SERVICES DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM;

PROVIDED THAT IN NO EVENT SHALL SUCH LIABILITY EXCEED THE MAXIMUM AMOUNT PERMITTED BY APPLICABLE LAW.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you. In such cases, the limitations shall apply to the fullest extent permitted by law.

  1. Indemnification

You agree to indemnify, defend, and hold harmless the Site owners and their affiliates, and their respective officers, employees, and agents, from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way related to:

  • your use of or reliance on the Site, Services, tools, calculators, or content;
  • your violation of these Terms; or
  • your violation of any applicable law, regulation, code, standard, or third‑party right.
  1. Changes to the Site and Services; No Duty to Update

The Site owners may, at any time and without notice:

  • modify, update, suspend, or discontinue any part of the Site or Services; and/or
  • restrict or terminate access to all or part of the Site or Services.

We do not undertake any obligation to update the Site or Services, including with respect to changes in laws, regulations, codes, standards, or technical guidance.

  1. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date at the top of this page. Your continued use of the Site after the updated Terms become effective constitutes your acceptance of them. If you do not agree to the updated Terms, you must stop using the Site.

  1. International Users

The Site may be accessed from locations around the world. The Site owners make no representation that the Services or content are appropriate or available for use in any particular jurisdiction.

If you access or use the Site from outside the United States, you do so on your own initiative and are responsible for compliance with all local laws, regulations, and codes that may apply, including those related to fire safety, process safety, construction, and engineering.

  1. Governing Law and Jurisdiction (Delaware)

These Terms and any dispute arising out of or relating to them, or to your use of the Site or Services, shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law principles.

You agree that the state and federal courts located in New Castle County, Delaware, USA (including the courts sitting in Wilmington, Delaware) shall have exclusive jurisdiction and venue over any legal action or proceeding arising out of or relating to these Terms or the Site, and you hereby consent to the personal jurisdiction of such courts.

  1. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.

  1. Entire Agreement and No Waiver

These Terms constitute the entire agreement between you and the Site owners regarding your use of the Site and Services and supersede any prior or contemporaneous agreements or understandings on that subject.

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Any failure to enforce any right or provision under these Terms shall not constitute a waiver of that right or provision.
